Welcome to SprkForge LLC! These Terms of Use ("Terms") govern your access to and use of the SprkForge LLC website (the "Platform"). By using SprkForge LLC, you agree to these Terms.
SprkForge LLC is a creative connector platform that allows customers with an idea to connect with skilled Makers who can bring that idea to life. SprkForge LLC currently operates as a free beta service to help facilitate communication between Customers and Makers. Use of the platform is limited to individuals 18 years or older.
Customers (Idea Holders): Individuals who post ideas or project requests seeking custom handmade creations. Customers may browse Maker profiles, initiate conversations through the Platform's in-app messaging system, and use the Platform's tools to track the status of any agreed commission.
Makers: Skilled artisans who view posted ideas and may reach out through the Platform's in-app messaging system to discuss and potentially create those projects. Makers may create a profile showcasing their work and medium, propose commission terms, and update commission progress through the Platform.
SprkForge LLC provides an in-app messaging system that allows Customers and Makers to communicate directly on the Platform. By using this feature, you acknowledge and agree that:
SprkForge LLC offers a "Finalize Agreement" feature that allows a Customer and a Maker to record mutually agreed-upon commission terms — including item description, price, timeline, and shipping details — directly within the Platform.
This feature is a platform-recorded acknowledgment only. It is not a legally binding contract, and SprkForge LLC is not a party to any agreement made through this feature. SprkForge LLC does not guarantee, enforce, or bear any responsibility for the terms, performance, or outcome of any agreement recorded through this feature.
Both parties must confirm their agreement for it to be recorded. Once confirmed, the terms are stored and visible to both parties in the conversation.
Users are solely responsible for ensuring that any agreed-upon terms are honored. SprkForge LLC strongly encourages users to exercise caution, communicate clearly, and use their own judgment before finalizing any agreement.
Once a Finalize Agreement is confirmed by both parties, SprkForge LLC provides a commission tracking feature within the Sprk Studio section of the dashboard. This feature allows users to update and view the status of a commission (e.g., In Progress, Delivered, Complete).
All items created through SprkForge LLC must be genuinely handmade by the Maker. Reselling items purchased from other stores or sources is not permitted. The purpose of SprkForge LLC is to foster original craftsmanship, not resale.
SprkForge LLC is designed to connect customers with Makers who create custom, handmade projects. It is not a marketplace for selling crafting materials, tools, or supplies. Any accounts using the site primarily for the sale of supplies may be removed at our discretion.
All users must respect the intellectual property rights of others. You may not post, request, or create projects that infringe upon or misuse copyrighted characters, logos, brand names, or other protected materials owned by third parties (e.g., Disney, Nintendo, Marvel). Makers and Customers are responsible for ensuring that their projects do not violate any intellectual property rights.
All ideas, images, messages, and communications shared on the Platform must be appropriate for a general audience. Users may not post or create projects or send messages that include or promote offensive, sexually explicit, violent, discriminatory, or otherwise inappropriate material. We reserve the right to remove content or accounts that violate this rule.
SprkForge LLC values your privacy. We do not sell, rent, or trade users' personal information to third parties. Any information provided — including messages and agreement terms — is used solely for operating the Platform and improving the user experience. Please review our full Privacy Policy for details on how your data is collected, stored, and used.
SprkForge LLC is currently in beta. Features and functionality may change. By using the Platform during this period, you acknowledge that the service may experience limited functionality or downtime.
SprkForge LLC may introduce paid features or transition to a subscription-based service in the future. Users will receive advance notice of any changes and may discontinue use if they do not wish to subscribe.
We may suspend or terminate accounts that violate these Terms or misuse the Platform. You may also stop using SprkForge LLC at any time.
SprkForge LLC provides a platform connecting Customers and Makers. We are not responsible for any agreements, transactions, communications, or outcomes between users, and we do not guarantee the quality, delivery, or results of any services or products. This includes any agreement recorded through the Finalize Agreement feature or any commission tracked through the Platform. Use of the Platform is at your own risk.
